ARTISTI has made its eighth royalty distribution of 2022, including the payment of SoundExchange’s royalties for payments delivered in June and July 2022.*

* Artisti having exceptionally received two months of SoundExchange royalties at a time (rather than just one), we make sure to split them both in time for this August 2022 distribution. However, please note that these payments should have reached us a month apart and that they would normally have been distributed to you on August 15 and September 15 respectively. Therefore, it is possible that the regular distribution of royalties from SoundExchange which is due to take place on September 15 will ultimately not take place. Thank you for your attention.

* IMPORTANT INFORMATION CONCERNING THE PARTIAL PAYMENT OF YOUR EQUITABLE REMUNERATION ROYALTIES FOR THE YEAR 2021.

Dear members,

In our February newsletter, we informed you that Re:Sound*, of which Artisti is a member, was replacing its distribution system and that, during this work, it was suspending its distribution of Canadian royalties until July 2022. We also indicated that the royalties corresponding to the broadcasts of 2021 would be delivered to you according to the regular distribution schedule, around July 2022.

However, due to problems specific to the development of this type of system, Re:Sound informed us that additional delays were to be expected and that the planned distribution of the 2021 royalties was delayed. Despite this, Artisti and the other Re:Sound member societies have ensured that a partial payment of these royalties (assessed based on a preliminary value per play) could be sent to you today.

This first payment of your 2021 royalties will be supplemented by the final distributions that Re:Sound should send to us using its new system in early fall 2022.

When the final payment of your 2021 royalties will be made, you will see on your Artisti portal that the partial payment we are sending you today will appear in negative and will be replaced by the final payment of your 2021 royalties which will appear in positive. You will then receive in your account the difference between the amount you collected today and the final amount of your royalties for 2021.

Also, while Artisti takes every precaution to avoid this situation, some of you may receive a payment today that is an overestimate or misstatement of what you would have normally received for your 2021 broadcasts. In this case, when the final payment will be made to us by Re:Sound, the sums that may have been overpaid to you will be recovered from your future royalty payments.

  • Canadian royalties for years prior to 2021

Artisti and the other Re:Sound member societies are working together to determine when and how the next royalty payment for years prior to 2021 will be made.

  • US royalties from SoundExchange and other royalties from foreign sources

Finally, be aware that US royalties paid by SoundExchange and other royalties from foreign sources will continue to be paid to you according to the regular distribution schedule.

*Re:Sound is the Canadian collecting society of equitable remuneration for performers and producers. As such, it is mandated by the Canadian collective societies members (Actra RACS, Artisti, Connect, MROC, Soproq) to collect royalties from the music services, and repay it to the societies members.

DETAILS OF THE TARIFFS INCLUDED IN THE FEBRUARY 15 DISTRIBUTION

ARTISTI has made its second distribution of 2022 including the payment of SoundExchange’s royalties delivered in December, 2021.

Refund of the US tax withholding on your SoundExchange 2013 royalties.

Artisti is relieved to send you a refund of US taxes that were withheld from your SoundExchange 2013 royalties.

While the reimbursement for the years 2012 and 2014 was made by the Internal Revenue Services (or IRS – the US tax service) in a considerably shorter time frame, we can say without exaggeration that the reimbursement for 2013 will have been the subject of a veritable crusade, since it was after 6 years of constant claims to the IRS that the latter finally sent almost all of the sums that had been deducted at source in connection with the year 2013.

Indeed, despite the many pitfalls beyond our control that our American tax experts had to face, the cumulative sums in capital received from the IRS in connection with the SoundExchange royalties for the year 2013 nevertheless represent 92.6% of sums for which Artisti requested reimbursement.

Moreover, given:

  1. the payment of interest by the IRS and
  2. the gain related to the fact that the exchange rate applying when the sums were received in 2021 was much higher than when the royalties were paid by SoundExchange in 2013,

the difference between what was withheld at source and what was paid to us is entirely made up and we are even happy to announce an average gain of 19.11% (i.e. 3.8% per year) compared to the whole sums withheld at source for the year 2013, and this, after deduction of Artisti’s management fees at the current rate of 3.5% (a lower rate than the various rates that were invoiced to you in connection with the sums of SoundExchange paid in 2013).

This refund is the last payment that Artisti had to send in connection with tax withholdings made from SoundExchange royalties because, since 2014, your royalties have been paid to you without any withholding at source being applied by the American society.
